A Partner at SRDB Law Firm since November 2021, Marie-Dominique Luccioni Faiola advises companies and professionals in the creative industries on business law, intellectual property, technology law and personal data protection. She acts in both advisory and contentious matters, with particular attention to her clients’ operational and commercial challenges.
In the field of new technologies, she advises on the design, development and commercialisation of digital solutions. Her practice includes the drafting and negotiation of IT agreements, software development agreements, licence agreements, maintenance agreements and digital services contracts, as well as general terms and conditions of sale and use. She also advises on legal issues relating to artificial intelligence, including compliance with the European Union’s Artificial Intelligence Act (AI Act), its interaction with the GDPR, the protection of content and data, and the contractual framework governing the development and use of AI systems.
Her data protection practice covers compliance with the General Data Protection Regulation (GDPR), the contractual framework governing data processing activities, and the management and security of relationships with service providers and business partners. She assists clients in preparing their compliance documentation, meeting transparency and information requirements, and addressing issues relating to confidentiality and the use of data.
Her assignments within the legal departments of industrial and service groups have enabled her to develop a practical understanding of how businesses operate. In particular, she has worked in the energy, equipment and hospitality sectors on commercial, IT, intellectual property, research and development, and data protection agreements.
In the artistic and cultural sectors, she assists authors, artists and creative professionals with the protection of their works, the structuring and securing of their collaborations, and the negotiation of their contracts. Her practice also includes media law, image rights and privacy protection.
In contentious matters, she acts notably in commercial disputes, infringement and unfair competition proceedings, as well as disputes relating to personality rights.
She holds a Master’s degree in Literary, Artistic and Industrial Property Law from Paris II Panthéon-Assas University and obtained the French Bar qualification (CAPA) in 2012. She has taught media law and intellectual property law at Aix-Marseille University. She also contributes to the firm’s publications, including on the legal protection of algorithms and databases.
